    Workman's Comp Waivers

    Our workman's comp carrier does not want to cover volunteers. We have always included them with a very low cost rider - in essence, coverage is very low, roughly $3,000 of annual salary. An example of a problem is: Suppose a lawyer volunteers, is injured, and subsequently files on you policy. The policy pays up to the wage limits utilized, but the company is on the hook for the difference, up to the wage ceiling (in our state, $36,000). That leaves a bunch of exposure to the company, which we obviously do not like. The broker is suggesting some kind of waiver the volunteer would sign indicating they waive the wc coverage. Does anyone have any kind of waiver like this? Or does anyone have any experience or thoughts regarding this issue?

    Our insurance covers accidental death & dismemberment to a maximum of $50K.  They are not covered by Worker comp (except our Work Experience students who get WCB coverage through their school's paperwork process).  We have them sign a separate liability waiver.  If you'd like an example (we have our old one and a newly updated one that we'll start using shortly)  send me an email.  Cheers, Rachelle
